Terms of Use

Welcome to QuitPuff. These Terms of Use (the “Terms”) govern your access to and use of the QuitPuff mobile application, website, and related services (together, the “Service”), operated by the QuitPuff team (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Who can use QuitPuff

You must be at least 18 years old to create an account. QuitPuff is a behavior-tracking tool and is not a medical device. It is not a substitute for professional medical advice, diagnosis, or treatment. If you have a health condition related to nicotine or vaping, consult a qualified healthcare professional.

2. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@quitpuff.app if you suspect unauthorized access.

3. Subscriptions and billing

QuitPuff Premium is offered as an auto-renewing subscription sold via Apple’s App Store and, in the future, Google Play. The following applies to iOS purchases:

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription automatically renews at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the price indicated in the app (currently USD $5.99 per week).
• You can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period; no partial refunds are issued for the unused portion of a term.
• A free trial, when offered, converts automatically to a paid subscription unless you cancel at least 24 hours before the trial ends.

4. Acceptable use

You agree not to:

• Use the Service for unlawful purposes or in violation of these Terms.
• Reverse-engineer, decompile, or attempt to extract the source code of the app, except as permitted by applicable law.
• Resell, sublicense, or commercially exploit any part of the Service without our written permission.
• Upload content that is illegal, abusive, or infringes on the rights of others.

5. Intellectual property

QuitPuff, the QuitPuff logo, the app interface, and all associated trademarks are our property. The Service is licensed, not sold, to you for personal, non-commercial use. Data you enter (your puff logs, goals, check-ins) belongs to you — see our Privacy Policy for how we handle it.

6. Disclaimer

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. QuitPuff does not guarantee that using the app will cause you to reduce or stop vaping.

7. Limitation of liability

To the maximum extent permitted by law, in no event will QuitPuff, its owners, or its contributors be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising out of these Terms will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

8. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. You may delete your account at any time from within the app (Settings → Account → Delete account) or by emailing us.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we’ll update the “Effective” date above and, for material changes, notify you inside the app. Continued use of the Service after a change means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which QuitPuff operates, without regard to its conflict of law principles. Any disputes will be resolved in the competent courts of that jurisdiction.
